Abstract

The advancement of digital media has facilitated the dissemination of information, including criminal cases, often at the expense of offenders’ privacy rights. This research aims to analyze the legal regulations governing the broadcasting of criminal offenders’ information in Indonesia and the forms of legal protection for their privacy rights. A normative legal research method was employed, utilizing statutory, conceptual, and comparative approaches, referencing Indonesia’s Broadcasting Law No. 32/2002, Electronic Information and Transactions Law (ITE Law), Personal Data Protection Law No. 27/2022, and national and international human rights instruments. The findings reveal that Indonesian regulations, such as Article 36 of the Broadcasting Law and Article 27A of the ITE Law, have established boundaries for media in reporting offenders’ identities, yet enforcement remains ineffective. The Indonesian Broadcasting Commission (KPI) oversees compliance through its Broadcasting Behavior Guidelines (P3SPS), but weak sanctions and rampant doxing on social media perpetuate privacy violations. The presumption of innocence (Article 8 of the Judicial Power Law) is often undermined by virality-driven stigmatization. A comparative study with Singapore, Germany, and the UK highlights Indonesia’s need for a specific legal framework to balance public interest and individual rights. The study recommends: (1) Revising the Broadcasting Law to explicitly prohibit pre trial publication of offenders’ identities, except for systemic crimes; (2) Strengthening KPI’s supervisory role over digital content; (3) Harmonizing the Personal Data Protection Law with limited exceptions for law enforcement; (4) Promoting digital literacy campaigns to mitigate trial by the press. This research contributes to strengthening privacy rights protection within the framework of due process of law in the era of information disruption.
