Abstract

The research examines the issue of criminal liability for perpeterous of animal rape (bestiality) who are individuals with disabilities. Bestiality constitutes a form of sexual violence against animal that not only violates legal and moral norms but also causes physical and pshycological suffering to animals as living beings incapable of giving consent. The complexity arises when the preperator has a disability particulary mental or intellectual disability which may legally exempt them from full criminal responsibility. This study aims to analyze the applicability od legal excuses (grounds for excuse) for disabled perperators of bestiality and to explore forms of punishment or legal actions that can be applied according to Indonesian criminal law. The research method used is normative juridical, employing a statutory and literature based approach, with a focus om the Criminal Code known as (KUHP) of 2023 and Law Number 8 of 2016 on Persons with Disabilities. The finding reveal that the under Indonesians criminal law, criminal liability requires the presence of fault (mens rea), which involves the ability to understand and be aware of the consequences of one’s action. Article 44 of the Criminal Code provides that individuals with severe mental disorders or intellectual disabilities may be exempted from criminal liability. However , the legal framework lacks specific provisions governing cases of bestiality involving disabled perperators, potentially leading to legal uncertainity. This study recommends the formulation of more comperehnsive regulations on bestiality, as well as the implementation of legal procedures that incorporate humanistic and rehabilitative approaches for person with disabilities. Such measures are essential to uphold justice without neglecting the rights of both the perpetrator and the (animal) victim, in accordance with the principles of inclusivity in Indonesia’s criminal justice system.
