Abstract

Sumber daya laut Indonesia meliputi cadangan minyak, gas, mineral dan batu bara yang sangat besar. Konsesi akan pentingnya laut yang kaya akan cadangan alam dan sumber devisa bagi negara telah diperkuat dengan pernyataan Internasional melalui Konvensi Hukum Laut yang disahkan oleh PBB yang disebut UNCLOS 1982. Berdasarkan Konvensi Hukum Laut atau UNCLOS 1982, negara pantai mengantongi eksklusifitas dasar laut landas kontinennya untuk mengeksplorasi serta mengeksploitasi devisa negara, dan secara otomatis memperoleh hak atas ekosistem atau devisa yang ditemukan di sana. Intensi dari penelitian ini ialah untuk memahami regulasi landas kontinen terkait eksplorasi dan eksploitasi minyak bumi brdasarkan regulasi internasional UNCLOS 1982. Jenis penelitian ini menggunakan metode penelitian hukum normatif yang bersifat preskriptif, dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Sumber hukum primer dan sekunder digunakan melalui inventarisasi dan penelitian kepustakaan. Ketentuan mengenai landas kontinen Indonesia terdapat dalam UU No. 1 Tahun 1973 tentang Landas Kontinen Indonesia, namun dalam UU No. 4 Tahun 2009 tentang Pertambangan dan Pertambangan Batu Bara, sebagaimana telah diubah dengan UU No. 3 Tahun 2020, dan UU No. 32 Tahun 2014 tentang Hukum Laut tentang Pertambangan Dasar Laut. Belum ada ketentuan khusus tentang pertambangan dasar laut. Indonesia harus mempertimbangkan untuk mengamandemen UU No. 1 tahun 1973, khususnya yang berkaitan dengan peraturan pertambangan dasar laut, dan memperbarui undang-undang sumber daya lautnya agar sejalan dengan standar internasional. Harmonisasi hukum diperlukan untuk membangun kerangka hukum terpadu untuk pengembangan sumber daya laut.
