Abstract

Penelitian ini membahas perselisih antara perizinan usaha PT. Sawit Mandiri Lestari (SML) dengan hak ulayat masyarakat adat Kinipan dalam perspektif pluralisme hukum. Perselisihan ini berakar dari ketidakharmonisan antara pengakuan hukum negara terhadap perizinan usaha perkebunan sawit dan klaim masyarakat adat atas tanah ulayat yang telah dimanfaatkan secara turun-temurun. Meskipun secara legal-formal izin PT. SML sah karena belum adanya pengakuan resmi terhadap status masyarakat hukum adat Kinipan, namun secara substantif terjadi ketimpangan keadilan hukum karena hak-hak masyarakat adat diabaikan. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang�undangan, konseptual dan pendekatan kasus. Melalui pendekatan pluralisme hukum yang dikembangkan oleh Werner Menski, penyelesaian Perselisihan ini dapat dilakukan dengan pengakuan resmi terhadap masyarakat adat dan hak ulayatnya sebagai sistem hukum yang sah, Mediasi atau perundingan partisipatif antara negara, perusahaan, dan masyarakat adat dengan mempertimbangkan tiga dimensi hukum dan reformulasi kebijakan agraria dan perizinan agar selaras dengan realitas pluralistik dan multikultural bangsa Indonesia serta penguatan ruang dialog untuk membangun solusi yang tidak hanya legal secara formal, tetapi juga adil secara sosial dan kultural.
