Abstract

Peralihan hak atas tanah yang dilakukan secara melawan hukum, khususnya melalui penipuan dan penggunaan dokumen palsu, merupakan salah satu bentuk pelanggaran terhadap asas kepastian hukum dan perlindungan hak milik atas tanah. Penelitian ini bertujuan untuk menganalisis unsur-unsur tindak pidana penipuan dalam perkara peralihan hak atas tanah berdasarkan Putusan Pengadilan Nomor 236/Pid.B/2021/PN Sda serta untuk memahami bentuk perlindungan hukum yang tersedia bagi korban. Dengan menggunakan metode penelitian hukum normatif melalui pendekatan perundang-undangan, konseptual, dan pendekatan kasus, penelitian ini menunjukkan bahwa pelaku dapat dimintai pertanggungjawaban tidak hanya secara pidana berdasarkan Pasal 378 KUHP, tetapi juga secara perdata melalui pembatalan perjanjian yang cacat kehendak dan tuntutan ganti rugi berdasarkan Pasal 1365 dan 1320 KUHPerdata. Selain itu, dalam perspektif hukum administrasi, pembatalan sertifikat dapat dilakukan jika terbukti diperoleh dengan cara melawan hukum. Penelitian ini menegaskan pentingnya perlindungan hukum menyeluruh terhadap korban dalam menjamin keadilan, kepastian hukum, dan itikad baik dalam sistem pertanahan Indonesia.
