Abstract

Hak cipta merupakan bagian dari hak kekayaan intelektual yang memberikan perlindungan hukum kepada pencipta atas karya orisinal yang dihasilkannya, termasuk lagu. Dalam era digital saat ini, pelanggaran hak cipta terhadap lagu semakin marak terjadi, terutama melalui situs penyedia layanan unduh lagu gratis tanpa izin. Penelitian ini bertujuan untuk mengkaji bentuk perlindungan hukum yang tersedia bagi pencipta lagu dalam menghadapi pelanggaran hak cipta, serta penegakan hukum di Indonesia. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap pencipta lagu telah diatur secara tegas, baik melalui perlindungan preventif (pencatatan ciptaan, lisensi, dan kontrak kerja sama) maupun represif (gugatan perdata dan tuntutan pidana). Namun, masih banyak terjadi pelanggaran hak cipta, terutama dalam aspek pengawasan dan penegakan hukum terhadap situs ilegal. Oleh karena itu, sinergi antara pemerintah, aparat penegak hukum, serta kesadaran masyarakat sangat diperlukan untuk menjamin hak pencipta lagu terlindungi secara optimal.
