Abstract
The development of the contract manufacturing business model raises legal issues related to the ownership of production methods used in the contract manufacturing process. The principal acts as the party who provides specific information, but is vulnerable to trade secret violations if the contract manufacturer misuses it. However, Law Number 30 of 2000 concerning Trade Secrets does not explicitly regulate the legal subject who is referred to as the owner of the trade secret. This research uses normative legal research methods with a conceptual approach and statutory approach. The types of legal materials used in this research are primary legal materials, secondary legal materials, and non-legal materials, using a prescriptive analysis technique. The results of this research show that the principal is the owner of the production method based on the principle of acquisition by acknowledgement as regulated in Article 584 of the Civil Code and reinforced by Article 606 of the Civil Code which states that if someone orders a product from another party using that party's materials, the ordering party remains the owner of the ordered goods. Protection of the production method can be carried out in two ways, namely externally in the form of state regulation and internally in the form of strengthening the clauses in the contract manufacturing agreement. Both forms of protection are important in creating legal certainty and preventing unfair business competition.
