Abstract

This thesis discusses the Sui Generis Regime Analysis in the Use of Geo Stationary Orbit According to the Principles of Space Law. This study uses a juridical normative research method, by analyzing primary data in the form of conventions, international agreements and regulations related to the use of Geo Stationary Orbit by developed and developing countries. Formulation of the problems obtained related to the application of the principles of space law related to the use of Geo Stationary Orbit (GSO) by developed countries and developing countries and the application of the sui generis regime in regulating the use and utilization of Geo Stationary Orbit (GSO) in space based on legal perspective space. In the first formulation of the problem, it was found that the use of GSO by developed and developing countries was in accordance with the principles of space law, such as the principle of equiatble access which explains the use of space must be accessible to all countries without exception, then based on the principle of freedom of use which explains the use of space is free to be used by developed countries and developing countries, is also in accordance with the principle of non-appraisal which states there is no claim of sovereignty by a country against the space area, and the principle of exclusively for peaceful purposes which states that any exploration and use of space activities including the use of satellites must be carried out for peaceful purposes and for the good of all humanity. In the second formulation of the problem, the basis for the submission of the rule of Sui Generis Regime in the use of GSO, based more on the utilization of the space area, must prioritize for the good of all humanity and can be a legacy of humanity and maintain the sustainability of the GSO orbit region resources in the long run, and can be mutually responsible based on the point of view of equality or difference of the interests of all countries so that it is expected to be able to provide justice and peace.
