Abstract

Penelitian ini mengkaji asas retroaktif dalam Undang-Undang Nomor 1 Tahun 2023 tentang KUHP Nasional Indonesia dan implikasinya terhadap penegakan hukum, khususnya dalam konteks pemberantasan korupsi. Asas retroaktif memperbolehkan undang-undang baru untuk diterapkan terhadap peristiwa-peristiwa yang terjadi sebelum berlakunya undang-undang tersebut, dengan ketentuan penerapan tersebut dinyatakan secara tegas dalam peraturan perundang-undangan. Aspek ini sangat penting untuk memastikan keadilan dalam kasus korupsi, karena aspek ini memungkinkan tindakan hukum terhadap individu yang mungkin menghindari tanggung jawab atas tindakan mereka. Selain itu, penelitian ini menyoroti pentingnya perjanjian ekstradisi antara Indonesia dan Singapura, yang bertujuan untuk memfasilitasi kerja sama dalam menangani kejahatan transnasional. Dimasukkannya ketentuan yang berlaku surut dalam perjanjian ini meningkatkan kemampuan Indonesia untuk mengejar buronan yang melarikan diri ke negara lain, sehingga memperkuat kolaborasi internasional dalam penegakan hukum. Kajian ini diakhiri dengan rekomendasi untuk meningkatkan kesadaran masyarakat luas mengenai prinsip retroaktif dan implikasinya terhadap sistem hukum, serta pentingnya memperkuat kemitraan internasional untuk secara efektif memerangi kejahatan lintas batas. Disarankan untuk meningkatkan pendidikan dan pelatihan bagi lembaga penegak hukum untuk memastikan penerapan undang-undang yang berlaku surut secara bertanggung jawab, sehingga menciptakan lingkungan hukum yang lebih kuat di Indonesia.
