Abstract

Indonesia sebagai negara hukum mempunyai peran krusial menegakan keadilan dan keteraturan, serta menjamin adanya kepastian hukum dalam kehidupan bermasyarakat tanpa adanya ketimpangan sosial dan perbedaan gender berdasarkan Hak Asasi Manusia. Penelitian ini bertujuan untuk mengetahui makna atau definisi terkait “penyiksaan seksual” yang terdapat dalam Pasal 4 ayat (1) huruf f Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual, serta mengetahui bentuk perlindungan hukum digunakan negara untuk melindungi korban penyiksaan seksual. Menggunakan jenis penelitian yuridis normatif dengan pendekatan konseptual, yang bertujuan untuk menjawab makna frasa “Penyiksaan seksual” karena tidak adanya penjelasan lebih pada undang-undang tersebut. Penelitian ini juga menggunakan pendekatan perundang-undangan yang meneliti berbagai aturaan hukum yang menjadi fokus utama dalam penelitian. Hasil dari pembahasan penelitian ini yaitu memberikan definisi terkait penyiksaan seksual yang ada pada Pasal 4 ayat (1) huruf f Undang-Undang No. 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual. Serta untuk mengetahui bentuk perlindungan hukum yang dapat digunakan oleh negara untuk melindungi korban penyiksaan seksual seperti pemidaan pelaku, restitusi, kompensasi, serta bantuan hukum untuk korban. Dengan melakukan perbandingan Peraturan Perundang-undangan dengan Konvensi Internasional.
