Abstract

Konsep hak imunitas bagi diplomat merupakan salah satu aspek penting dalam menjaga kelancaran hubungan antarnegara melalui saluran diplomasi. Keberadaan hak ini memberikan perlindungan hukum terhadap para pejabat diplomatik agar mereka dapat menjalankan tugasnya tanpa gangguan dari yurisdiksi negara penerima. Konvensi Wina 1961 tentang Hubungan Diplomatik menjadi instrumen hukum internasional utama yang mengatur secara sistematis mengenai hak dan kewajiban para diplomat, termasuk ketentuan mengenai hak imunitas. Penelitian ini bertujuan untuk memahami bagaimana pengaturan hak imunitas diplomat dalam Konvensi Wina 1961, serta memahami bagaimana batasan hak imunitas diplomat jika ditinjau dari Konvensi Wina 1961. Selain itu, penelitian ini juga mengkaji aspek kepastian hukum bagi negara pengirim dan penerima dalam kaitannya dengan pelaksanaan hak imunitas tersebut, serta menganalisis kemungkinan pengabaian (waiver) imunitas oleh negara pengirim sebagai bagian dari mekanisme hukum yang diatur dalam konvensi. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, serta kasus untuk menggambarkan penerapan hak imunitas dalam berbagai peristiwa nyata. Hasil penelitian menunjukkan bahwa perlindungan imunitas tidak bersifat mutlak dan tunduk pada prinsip-prinsip fungsionalitas serta penghormatan terhadap kedaulatan negara penerima. Oleh karena itu, penting bagi negara untuk memahami secara utuh ruang lingkup imunitas diplomatik demi menjaga keseimbangan antara pelaksanaan fungsi diplomatik dan penegakan hukum di wilayah negara penerima.
