Abstract

Pernikahan merupakan institusi fundamental dalam masyarakat Indonesia yang memiliki kedudukan penting baik dari segi agama maupun hukum. Secara agama, pernikahan dipandang sebagai ikatan sakral antara pria dan wanita untuk membentuk keluarga yang harmonis dan sejahtera. Sementara itu, dalam konteks hukum positif, pernikahan harus dicatatkan secara resmi agar memperoleh pengakuan dan perlindungan hukum. Ketidak tercatan pernikahan menimbulkan kebutuhan akan isbat nikah sebagai upaya pengesahan pernikahan yang telah dilangsungkan secara agama namun belum tercatat secara hukum negara. Penelitian ini bertujuan untuk menganalisis pembatalan isbat nikah berdasarkan Putusan Pengadilan Agama Surabaya Nomor 1376/Pdt.G/2022/PA.Sby yang dikeluarkan pada 12 Juli 2022. Kasus ini menunjukkan kompleksitas hukum yang terlibat dalam pembatalan isbat nikah, di mana pihak yang merasa dirugikan mengajukan banding ke Pengadilan Tinggi Agama Surabaya. Pada 22 September 2022, PTA Surabaya mengeluarkan Putusan Nomor 350/Pdt.G/2022/PTA.Sby yang membatalkan putusan sebelumnya dan menyatakan bahwa gugatan penggugat tidak dapat diterima, menandakan adanya tantangan dalam memenuhi syarat prosedural yang ditetapkan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan studi kasus. Hasil penelitian menunjukkan bahwa pembatalan isbat nikah terjadi karena permohonan awal diajukan tanpa melibatkan pihak-pihak yang memiliki kepentingan hukum langsung, yakni istri sah dari pihak yang telah meninggal. Hal ini menimbulkan cacat prosedural yang melanggar asas keadilan dan ketentuan hukum positif, termasuk SEMA Nomor 3 Tahun 2018. Pembatalan isbat nikah membawa konsekuensi yuridis yang signifikan, termasuk hilangnya status hukum perkawinan serta implikasi terhadap pemenuhannya hak-hak sipil anak dan status harta bersama. Oleh karena itu, penting bagi proses isbat nikah untuk dijalankan sesuai prosedur hukum secara ketat demi menjamin keadilan dan kepastian hukum bagi seluruh pihak.
