Abstract

Propaganda orientasi seksual LGBT kepada anak merupakan isu yang menimbulkan kekhawatiran terhadap perlindungan hak anak atas informasi yang sesuai usia. Dalam hukum Indonesia, belum terdapat ketentuan yang secara eksplisit melarang atau mempidanakan bentuk propaganda semacam ini, khususnya di media edukatif dan digital. Penelitian ini bertujuan untuk menganalisis urgensi pengaturan pemidanaan terhadap propaganda LGBT kepada anak dan bentuk pertanggungjawaban pidananya. Metode yang digunakan adalah pendekatan yuridis normatif melalui pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa terdapat kekosongan norma dalam hukum positif yang berpotensi membuka ruang penyebaran konten bermuatan LGBT kepada anak secara bebas, baik melalui media sosial, buku, maupun animasi digital. Konten semacam ini dapat menimbulkan disonansi kognitif, kebingungan identitas seksual, dan normalisasi perilaku yang belum pantas dikenali oleh anak di usia dini. Selain itu, belum adanya kategorisasi yang jelas terhadap pelaku propaganda, seperti penulis, pengunggah, atau pengelola media, menyebabkan lemahnya dasar pertanggungjawaban pidana. Oleh karena itu, diperlukan pembaruan hukum yang secara tegas melarang segala bentuk propaganda orientasi seksual kepada anak demi melindungi perkembangan psikologis, moral, dan identitas anak.
