Abstract

The development of artificial intelligence technology presents new challenges in the field of intellectual property law, particularly in copyright protection. Law Number 28 of 2014 on Copyright in Indonesia has yet to accommodate the reality that artificial intelligence can independently generate works, resulting in a legal vacuum and uncertainty for users, developers, and creative industry stakeholders. This research employs a normative legal method with statutory, conceptual, and comparative approaches, particularly referencing the legal framework in the United Kingdom. The findings indicate that works produced by artificial intelligence cannot be classified as “creations” under Indonesian copyright law, as they do not fulfill the requirement of a human legal subject as the creator. However, countries like the United Kingdom, through the Copyright, Designs and Patents Act 1988, provide a solution by recognizing the person who makes the necessary arrangements for the creation process as the copyright holder. In Indonesia, the lack of regulation may hinder innovation and give rise to ownership disputes. Therefore, legal reform is necessary by adding specific provisions to the Copyright Law that recognize human contribution in the creation of AI-generated works as the basis for copyright ownership. This hybrid approach can serve as a bridge between the principle of originality in copyright law and technological advancement. The study emphasizes the urgency of legal reform to address the challenges of the digital era while ensuring protection, legal certainty, and a sustainable innovation climate in Indonesia.
