Abstract

Penelitian ini membahas urgensi dan model pembatasan kewenangan Mahkamah Konstitusi dalam menjalankan peran sebagai positive legislator. Meskipun Mahkamah Konstitusi secara konstitusional berfungsi sebagai negative legislator, dalam praktiknya lembaga ini kerap memutus perkara pengujian undang-undang dengan membentuk norma baru yang melampaui kewenangan aslinya. Fenomena tersebut memunculkan perdebatan yuridis karena berpotensi menimbulkan disrupsi terhadap prinsip pemisahan kekuasaan, mengaburkan batas antara fungsi yudisial dan legislatif, serta memunculkan risiko supremasi yudisial tanpa akuntabilitas. Berdasarkan metode penelitian hukum normatif dengan pendekatan perundangundangan, konseptual, dan kasus, penelitian ini mengidentifikasi enam urgensi pembatasan serta merumuskan dua model pembatasan tambahan. Temuan ini menekankan bahwa diperlukan landasan hukum eksplisit dalam perubahan UndangUndang Mahkamah Konstitusi untuk mengatur secara tegas kapan Mahkamah Konstitusi diperbolehkan menjalankan kewenangan positive legislator. Pembatasan tersebut harus dibatasi pada kondisi tertentu, seperti, demi menjamin keadilan substantif seluruh masyarakat, kondisi yang mendesak dan untuk mengisi kekosongan hukum agar tidak terjadi kekacauan. Penelitian ini juga menawarkan dua model pelengkap: constitutionally bounded interpretation protocol dan institutional dialog model sebagai kerangka pengaman prosedural dan institusional yang dapat menyeimbangkan kewenangan yudisial dan supremasi legislatif.
