Abstract

A Building Use Rights Certificate (SHGB) is frequently employed as collateral for bank credit due to its high economic value and legal certainty afforded by land registration. However, the limited duration of SHGB poses legal risks if the certificate expires before loan repayment. This study examines the legal status of SHGB as credit collateral under Indonesia’s Mortgage Law (Law No. 4/1996) and evaluates creditor protection mechanisms in the event of debtor default. Employing a normative‐juridical methodology with statutory and conceptual approaches, the research analyzes primary and secondary legal materials qualitatively. The findings confirm that SHGB may validly serve as a security interest once a Mortgage Deed is executed and registered with the National Land Agency. Nevertheless, failure to renew the SHGB prior to expiration can extinguish the security interest, undermining credit enforcement. Accordingly, loan agreements should include provisions mandating SHGB renewal or substitution with alternative collateral, and creditors must monitor certificate validity. Implementing these measures will sustain legal protection and transaction certainty for all parties involved in asset‐backed financing.
