Abstract

This study discusses legal protection for victims of sexual violence based on psychological manipulation. Psychological manipulation in sexual violence aims to control, manipulate, and exploit victims in ways that do not always involve physical coercion, but use psychological strategies that make victims feel bound, helpless, or even guilty. This study aims to answer two problem formulations, namely (1) How is the proof of criminal acts of sexual violence based on psychological manipulation? (2) How is the legal protection for victims of sexual violence who experience psychological manipulation? This study aims to analyze the lack of regulations regarding the definition and legal indicators of sexual violence based on psychological manipulation, considering the difficulty of the process of proof and granting victims' rights. This study uses a normative method with a legislative and conceptual approach, and uses primary, secondary, and tertiary legal materials that are analyzed descriptively. The results of the study show that although Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence has regulated various forms of sexual violence, the existing regulations still do not provide clear regulations regarding forms of sexual violence based on psychological manipulation which results in the weak position of the victim in the judicial process, especially in proving the existence of elements of violence that are not physical.This study highlights the importance of clear legal regulations to ensure acts of sexual violence in understanding the pattern of psychologicalmanipulation as a form of sexual violence that is detrimental to victims. Thus, this study emphasizes the importance of a holistic approach that integrates legal aspects, evidence, and legal protection for victims.
