Abstract

Penyadapan merupakan sarana berbasis teknologi yang digunakan untuk membongkar kejahatan melalui alat elektronik seperti telepon, komputer, laptop, dan alat elektronik lainnya. Penyadapan dapat digunakan pada tindak pidana tertentu saja seperti tindak pidana korupsi, dan yang memiliki kewenangan untuk melakukan penyadapannya tidak lain adalah KPK dan Kejaksaan. Dalam melakukan penyadapan, KPK dan Kejaksaan harus mematuhi syarat dan prosedur untuk dilakukannya penyadapan, sayangnya masih belum ada undang-undang yang mengatur secara khusus tentang penyadapan. KPK dan Kejaksaan hanya mendasari ketentuan undang-undang miliknya yakni undang-undang KPK dan undang-undang Kejaksaan. Sayangnya, dalam undang-undang Kejaksaan belum mengatur secara jelas tentang prosedur untuk dilakukan penyadapan seperti undang-undang KPK, dan kedua undang-undang tersebut juga belum mengatur tentang perlindungan hukum yang dapat diberikan pada korban yang dirugikan akibat tindakan penyadapan yang tidak sah oleh KPK ataupun Kejaksaan. Penelitian ini bertujuan untuk mengetahui pengaturan penyadapan yang sah dan tidak bertentangan dengan ketentuan Hak Asasi Manusia serta untuk mengetahui perlindungan hukum yang dapat diberikan pada korban yang dirugikan akibat tindakan penyadapan yang tidak sah, dengan fokus pada langkah-langkah preventif dan represif yang dapat diterapkan. Metode penelitian yang digunakana adalah penelitian hukum normatif, dengan pendekatan Perundang-undangan dan konseptual, serta analisis terhadap bahak hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa pengaturan penyadapan melalui undang-undang KPK ataupun Kejaksaan sebenarnya bisa mengikuti ketentuan yang ada pada RKUHAP dari segi pengajuan perizinannya karena yang memberikan izin adalah ketua pengadilan, sehingga bisa meminimalisir tindakan penyadapan tidak sah. Kemudian untuk perlindungan hukum yang dapat diberikan adalah dengan ditambahkannya objek penyadapan sebagai upaya praperadilan untuk korban yang dirugikan, sehingga bisa memulihkan kembali harkat dan martabat dari korban.
