Abstract

There are still some cases where the notary is less thorough in studying or deliberately drafting the deed without considering other heirs. The notary's responsibility is related to the deed of transfer of shares prepared before the notary, which is the basis for the transfer of rights to shares. This has led to many problems related to the deed of transfer being brought to court by the heirs of the grantor, especially when the transfer is made without the knowledge of the other heirs, to the detriment of the rights that should have been received by them. The validity of a deed of transfer that does not follow the applicable regulations can cause the deed to be invalid.This research method is normative with statutory and conceptual approaches. The results show that the transfer is an agreement that must comply with Article 1320 of the Civil Code regarding the validity of the agreement. In this case, the transfer does not fulfill all the elements of an agreement, including agreement, capacity, specific object, and legitimate cause. As a result, the deed of transfer is invalid. Individuals who are incapable of performing legal acts require the guardianship of other heirs as well as the consent of all heirs, as biological children also have rights over the object of the share transfer. The notary who drafts the deed of transfer may be liable for negligence that causes harm to the heirs, in accordance with Article 1365 of the Civil Code. Responsibilities related to the transfer include professional responsibility, civil responsibility, and administrative responsibility.
