Abstract

Legal protection for land rights holders designated as abandoned land in Indonesia. This study aims to analyze the regulations governing the designation of abandoned land and their implications for the rights of land rights holders. Based on Government Regulation Number 20 of 2021, land is considered abandoned if it is not utilized in accordance with its conditions and the purposes of its rights, resulting in the revocation of rights by the state. Using a normative juridical approach, this study found that the procedure for determining abandoned land includes inventory, evaluation, and warnings to rights holders. The legal consequence of this designation is the revocation of land rights and the repossession by the state, which is then categorized as State General Reserve Land (TCUN). This study also highlights the administrative objection mechanism as a legal remedy for rights holders to maintain their ownership before the decision to revoke rights is implemented. The results of the study indicate that although the legal framework for land rights protection has been established, its implementation still faces challenges, particularly related to community understanding of their rights and obligations. Therefore, it is recommended that the government increase legal outreach and education to ensure that rights holders understand the legal status of their land and can effectively protect their rights, encourage community participation in land management, and create a more equitable and sustainable land system.
