Abstract

Banyaknya platform investasi yang diciptakan oleh broker sebagai sarana tempat untuk trading online, dalam platform terdapat banyak fitur-fitur layanan yang dicipatakan, salah satunya yaitu copy trading. Copy trading adalah salah satu fitur yang sangat membantu trader pemula dengan cara meng-copy transaksi dari trader ahli (master trading) secara otomatis. Dengan adanya fitur copy trading maka trader pemula bisa memilih master trading untuk dijadikan role model. Dalam sistem copy trading adanya profit sharing (bagi hasil) antara pihak copyer (pemilik modal) dan master trading (pengelola modal). Usaha yang dijalankan oleh master trading yaitu perdagangan forex (mata uang). Penelitian ini dilakukan untuk menjawab permasalahan tentang Apakah klausula pengalihan tanggung jawab dalam copy trading forex sah menurut prinsip perlindungan konsumen di Indonesia?, dan Bagaimana perlindungan hukum terhadap pengguna copy trading dalam trading foreign exchange (forex)?. Penelitian ini menggunakan metode penelitian yuridis normatif. Hasil penelitian ini adalah Klausula pengalihan tanggung jawab (klausula eksonerasi) dalam copy trading forex tidak sah menurut prinsip perlindungan konsumen di Indonesia. Perlindungan hukum terhadap pengguna copy trading dalam trading forex di Indonesia sudah diatur dengan baik melalui berbagai peraturan yang melibatkan BAPPEBTI, Self Regulatory Organization (SRO), dan asosiasi terkait.
