Abstract

Captured marriage is a customary practice that still occurs in Sumba, East Nusa Tenggara (NTT), and is often carried out without the consent of women. This tradition creates a legal dilemma, because on the one hand it is considered part of the local culture, but on the other hand it contains elements of coercion, displacement, and exploitation that can fulfill the elements of the crime of human trafficking. This study aims to examine whether captured marriage can be categorized as a crime of human trafficking based on Law Number 21 of 2007, and to examine the legal protection provided to women who are victims. The research method used is normative juridical with a statutory and conceptual approach. The results of the study indicate that the practice of captured marriage can fulfill the elements of the crime of human trafficking, especially if it is carried out by force and harms the rights of the victim. Legal protection for women in this case is not optimal, because it is hampered by strong customary values and minimal law enforcement in the region. Therefore, integrated legal and social efforts are needed to protect women's rights while respecting local wisdom selectively and critically.
