Abstract
Debt restructuring through the Suspension of Debt Payment Obligations (PKPU) mechanism serves as an alternative for debtors facing financial difficulties to avoid bankruptcy. However, in practice, this process often creates legal protection disparities between secured creditors and concurrent creditors. Concurrent creditors, who do not hold collateral, are frequently in a weak and legally unprotected position, both during the negotiation of the composition plan and its execution. This research aims to examine the legal consequences of a composition plan decision on concurrent creditors and to analyze the forms of legal protection available to them in the debt restructuring process through PKPU. The method used in this study is normative juridical with statutory, conceptual, and case approaches, focusing on relevant legal norms and analyzing two case studies: PT Duniatex Group and PT Garuda Indonesia. The results show that concurrent creditors are bound by the approved composition plan, even if they voted against it, as stipulated in Article 286 of the Indonesian Bankruptcy Law. Their position heavily relies on the plan's contents, which often involve reduced claims and extended repayment periods. Although the law formally provides protection such as voting rights and the right to file for annulment—its implementation remains weak. The case studies reveal that concurrent creditors bear high risks with limited payment guarantees. Therefore, stronger regulatory frameworks and more effective protection mechanisms are urgently needed.
