Abstract

Penelitian ini dilakukan untuk menganalisis dan mengetahui meneganai kedudukan suatu bentuk dari aset digital dalam hal sebagai warisan pada pewarisan yang berlaku di Indonesia. Penelitian ini menggunakan beberapa metode dari penelitian hukum normatif antara lain penelitian hukum dengan menggunakan aturan hukum, prinsip-prinsip hukum maupun doktrin-doktrin hukum untuk menjawab isu yang dihadapi, selain itu dalam penelitian ini juga menggunakan 2 metode pendekatan, yaitu berupa pendekatan konseptual (conceptual approach) dan pendekatan perundang-undgan (statute approach). Prosedur pengalihan Hak Cipta atas suatu aset digital melalui warisan melibatkan beberapa tahapan penting. Ahli waris perlu membuat akta waris sebagai bukti otentik kepemilikan hak. Proses ini harus disertai dengan surat keterangan kematian dan surat keterangan waris. Mengenai pengalihan hak melalui warisan ini sebaiknya disusun oleh notaris atau pejabat/instansi yang berwenang dalam pembuatan akta waris. Setelah akta waris selesai, langkah selanjutnya adalah mencatatkan hak cipta tersebut ke Direktorat Jenderal Kekayaan Intelektual. Dalam proses pencatatan ini, ahli waris sebagai pemilik Hak Cipta wajib melampirkan dokumen-dokumen pengalihan hak yang relevan. Selain itu, pengalihan hak tersebut juga harus diumumkan dalam berita resmi yang sesuai dengan jenis Kekayaan Intelektual yang bersangkutan. Dengan mengikuti prosedur ini, ahli waris dapat memastikan bahwa hak cipta yang diwariskan dapat diakui secara hukum dan dilindungi.
