Abstract

Penelitian ini bertujuan untuk mengetahui kelemahan perlindungan hukum terhadap perempuan korban penyebaran vidio berkonten kekrasan seksual.sebelum disahkannya Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual dan bentuk perlindungan hukumnya setelah disahkannya Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual. Penelitian ini penting untuk mengkaji pengaturan tindak pidana kekerasan seksual dan perlindungan hukum bagi korban, menggunakan metode penelitian hukum normatif dengan studi kepustakaan dan analisis data sekunder yang mencakup peraturan perundang-undangan, literatur, dan kasus hukum. Hasil penelitian menunjukkan bahwa peredaran video porno diatur dalam Undang-Undang Nomor 19 Tahun 2016, yang merupakan perubahan dari Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Pertanggungjawaban pidana bagi pelaku peredaran video porno memenuhi tujuan hukum dan aspek subjektif yang diatur dalam Pasal 29 ayat 1 tentang pornografi, serta Pasal 27 ayat 1 dan Pasal 45 ayat 1 UU Keterbukaan Informasi dan Teknologi Elektronik. Dalam kasus yang diteliti, terdakwa dijatuhi hukuman 12 tahun penjara setelah mengakui kesalahannya. Penelitian ini juga mengidentifikasi bentuk kekerasan seksual di media sosial, baik eksplisit maupun implisit, dan menekankan pentingnya kesadaran masyarakat untuk menciptakan lingkungan yang lebih aman dan berkeadilan. Penulis berharap temuan ini dapat menjadi acuan bagi pihak terkait dalam penegakan hukum yang lebih efektif dan peningkatan kesadaran masyarakat.
