Abstract

Workplace accidents are unpredictable events before they can be avoided or their impact minimized. Accidents cause losses, both to the sufferer and materially. Accidents can occur in the form of accident or planned in advance. The existence of work accidents causes the need for effective implementation of Occupational Health and Safety (OHS) in the work environment. OHS is an effort made for workers or employers with the aim of preventing occupational accidents and diseases due to work relations in the work environment by recognizing things that have the potential to cause occupational accidents and diseases due to work relations, as well as anticipatory actions if this happens so that legal protection is needed. The research method used in this thesis is normative juridical research. The results showed that the company's obligations in implementing OHS are legal obligations that must be fulfilled and protection instruments that aim to create a safe workplace and minimize the risk of accidents. to determine the company's responsibility, it is necessary to have company obligations and implement adequate legal protection mechanisms for victims and their heirs. This research shows that the company's obligations in the implementation of OHS according to labor regulations in Indonesia include the implementation of commitments to the implementation of OHS, the provision of infrastructure for the implementation of OHS, the implementation of worker training on OHS, the management of occupational accident risks. To protect victims of work accidents, it is important for companies to implement an effective OHS management system and provide protection guarantees to workers, this includes death benefits and medical treatment costs as the responsibility of employers and contractors as well as the rights of workers in obtaining legal protection which is regulated in various regulations, namely Article 15 Paragraph (2) of Law Number 1 of 1970 concerning work safety, Articles 186 and 190 of Law Number 13 of 2003, and Article 25 of Government Regulation Number 44 of 2015 concerning the implementation of the Work Accident and Death Insurance Program.
