Abstract
Undang-Undang Nomor 1 Tahun 2024 tentang Informasi dan Transaksi Elektronik (UU ITE) secara tegas mengatur tentang tindak pidana ancaman kekerasan dan/atau menakut-nakuti melalui media elektronik, akan tetapi tidak dijelaskan mengenai batasan yang diperlukan untuk mengklasifikasi tindak pidana media elektronik tersebut. Penelitian ini bertujuan untuk menganalisis definisi, unsurunsur, bentuk-bentuk dan juga terkait dengan faktor–faktor ancaman kekerasan dan/atau menakut–nakuti yang diatur dalam UU ITE. Dari norma samar tersebut sehingga muncullah rumusan masalah terkait dengan makna frasa ancaman kekerasan dan/atau menakut–nakuti Pasal 29 UU ITE, dan juga permasalahan mengenai bagaimana perlindungan hukum bagi para korban ancaman kekerasan dan/atau menakut–nakuti dalam Pasal 29 UU ITE. Penelitan ini menggunakan metode penelitan normatif dengan menggunakan sumber data primer dan data sekunduer, serta menggunakan pendekeatan perundang–undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa ancaman dalam konteks UU ITE memiliki makna yang luas, tidak hanya terbatas pada ancaman fisik, tetapi juga mencakup ancaman psikologis dan ancaman terhadap harta benda. Ancaman tersebut dapat dilakukan melalui berbagai platform media sosial dan aplikasi pesan instan yang dimiliki oleh semua pengguna media sosial.
