Abstract
Penelitian ini membahas kedudukan kreditur separatis dalam pelaksanaan eksekusi hak tanggungan milik debitur pailit di Indonesia. Fokus penelitian adalah pada mekanisme eksekusi hak tanggungan serta perlindungan hukum yang diberikan kepada kreditur separatis setelah masa tangguh eksekusi berakhir. Kreditur separatis memiliki hak istimewa berdasarkan Undang-Undang Nomor 4 Tahun 1996 tentang Hak Tanggungan dan Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan PKPU. Namun, ketentuan dalam kedua undang-undang tersebut menimbulkan potensi disharmoni hukum, khususnya terkait masa penangguhan eksekusi dan batas waktu pelaksanaan eksekusi oleh kreditur separatis. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa perlu adanya harmonisasi peraturan terkait untuk memberikan kepastian hukum dan efektivitas pelaksanaan eksekusi hak tanggungan, serta perlindungan yang optimal bagi kreditur separatis.
