Abstract

Surplus embryos inin vitro fertilization(IVF) are the result of a medical process where not allembryos produced can or need to be implanted into the mother's womb. These embryos retain pluripotent potential, meaning they can develop into cells of certain organs. However, the utilization of these leftover embryos is a controversial issue from an ethical, religious and legal standpoint. Those who oppose the utilization of leftover embryos argue that embryos are early forms of human life that have dignity and the right to be respected. Destruction of embryos is considered equivalent to actions that eliminate the potential for life. In addition, supporters of the utilization of residual embryos see opportunities to use these embryos in medical research such as stem cells, which can provide great benefits for saving human lives. Regulations in Indonesia stipulate that leftover embryos can be stored for a certain period of time for the purposes of subsequent pregnancies, as stated in the Minister of Health Regulation and related Government Regulations. However, there are no detailed guidelines regarding the utilization of leftover embryos for research or scenarios if the embryos are no longer used. This poses a dilemma, both from a legal and ethical perspective. Therefore, an in-depth study is needed to ensure that regulations protect human dignity and firmly set limits on embryo utilization. The legal approach must take into account human values, justice, as well as diverse cultural and religious views in society. Without clear regulations, the utilization of surplus embryos hasthe potential to cause serious social, ethical and legal problems.
