Abstract
The appointment of Acting regional heads by the central government has become a legal issue related to the constitutionality of the Acting Head. Problems arise regarding the constitutionality of the appointment of this regional head position, especially in relation to Article 18 paragraph (4) of the 1945 Constitution of the Republic of Indonesia. The mechanism for appointing the Acting Head is not specifically mentioned in the 1945 Constitution, so the central government through the Minister of Home Affairs issued Permendagri No.4/2023 to specifically regulate the appointment of the Acting Head of the region. The vacancy of the regional head position occurred due to the holding of the 2024 national simultaneous vote, the consequences of the national simultaneous vote in 2022 and 2023 were eliminated. From the explanation above, this study aims to analyse the constitutionality of the appointment of Acting regional heads regulated in Article 201 paragraph (9) of Law No. 6/2020 in accordance with Article 18 paragraph (4) of the 1945 Constitution, with the phrase ‘democratically elected’. This research uses normative legal research, which places the law as a system of legal norms. The system of legal norms built is about principles, norms, laws and regulations, court decisions, agreements, and legal doctrines. The results showed that the appointment of Acting regional heads by the central government to fill the position of the head normatively fulfils the requirements of Article 201 paragraphs (10) and (11) of Law No. 6/2020. However, the appointment of the Acting regional head materially and substantially violates the principles of constitutionalism, namely the rule of law and democracy, as well as regional autonomy as stated in the 1945 Constitution of the Republic of Indonesia.
