Abstract

Izin perkawinan beda agama yang diberikan Pengadilan Negeri Bekasi melalui Putusan Nomor 91/Pdt.P/2022/PN Bks. Pasangan yang berbeda agama diberikan izin guna melaksanakan perkawinan, meskipun isu ini bertentangan atas ketentuan Pasal 2 Ayat (1) Undang-Undang Nomor 1 Tahun 1974 mengenai Perkawinan, dalam hal mensyaratkan yang menyatakan perkawinan hanya boleh dilaksanakan oleh pasangan seagama. Tujuan dari penelitian ini ialah guna memahami dan melaksanakan analisis pertimbangan hakim dalam memutuskan permohonan perkawinan beda agama pada penetapan Nomor 91/Pdt.P/2022/PN Bks. Metode yang dipakai melalui penelitian ini ialah penelitian normatif, melalui memakai pendekatan perundang-undangan (statute approach), konseptual (conceptual approach), dan kasus (case approach), guna melaksanakan analisis putusan-putusan pengadilan yang relevan serta bagaimana hakim memutuskan perkara serupa. Hasil penelitian menampilkan meskipun hukum yang ada melalui jelas melarang perkawinan beda agama, pengadilan dalam pertimbangannya lebih mengedepankan nilai keadilan dan hak asasi manusia, yang memungkinkan perkawinan beda agama guna dipertimbangkan dan diberikan izin. Meskipun Pasal 2 Ayat (1) Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan melalui tegas menetapkan perkawinan hanya boleh dilaksanakan antara pasangan seagama, pertimbangan hakim menampilkan adanya pemahaman yang lebih terhadap norma hukum yang berlaku. Perkawinan beda agama di Indonesia dinyatakan tidak sah berdasarkan Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, yang mensyaratkan perkawinan harus dilaksanakan sesuai dengan hukum agama masing-masing. Dalam isu ini, mayoritas ajaran agama di Indonesia, termasuk Islam dan Kristen, tidak mengakui keabsahan perkawinan beda agama. Ketidaksahan tersebut berimplikasi pada status hukum pasangan, dan hak-hak lain yang terkait, seperti waris dan administrasi kependudukan. Berdasarkan hasil penelitian ini dasar hukum dan pandangan keagamaan yang melarang perkawinan beda agama serta dampaknya terhadap masyarakat. Penelitian ini juga menyoroti ketegangan antara prinsip hukum agama, ketentuan hukum negara, dan nilai-nilai hak asasi manusia dalam upaya menemukan solusi hukum yang lebih inklusif tanpa melanggar norma keagamaan yang berlaku.
