Abstract

Pemberian penghargaan dan ganti rugi terhadap pendonor organ merupakan isu yang kompleks, terutama ketika dihadapkan pada regulasi yang belum secara jelas mengatur mekanisme dan bentuk penghargaan serta kompensasi tersebut. Penelitian ini bertujuan untuk menganalisis pengaturan hukum terkait pemberian penghargaan dan ganti rugi bagi pendonor organ, serta mengidentifikasi norma kosong dalam regulasi yang ada. Fokus utama kajian adalah Pasal 357 Peraturan Pemerintah No. 28 Tahun 2024, yang memberikan dasar bagi pemberian penghargaan kepada pendonor organ, namun tidak menjelaskan bentuk konkret penghargaan tersebut. Hal ini menciptakan ketidakpastian hukum yang dapat berdampak pada minimnya perlindungan bagi pendonor. Selain itu, penelitian ini juga membahas konsep perlindungan hukum yang seharusnya diberikan kepada pendonor organ, baik dalam bentuk penghargaan moral maupun kompensasi finansial. Metode normatif digunakan untuk mengkaji peraturan perundang-undangan, termasuk kaitannya dengan Pasal 124 ayat (3) Undang-Undang No. 17 Tahun 2023 tentang Kesehatan yang melarang komersialisasi organ, serta Pasal 1365 KUHPerdata yang mengatur ganti rugi atas kerugian akibat perbuatan melawan hukum. Hasil penelitian menunjukkan bahwa diperlukan regulasi lebih rinci untuk mengisi kekosongan norma terkait mekanisme penghargaan dan kompensasi, dengan memperhatikan prinsip keadilan, keseimbangan hak dan kewajiban, serta perlindungan hukum yang memadai bagi pendonor organ. Penelitian ini diharapkan memberikan kontribusi terhadap pengembangan kerangka hukum yang lebih adil dan komprehensif, guna mendorong praktik donasi organ yang sesuai dengan prinsip solidaritas sosial tanpa mengabaikan hak-hak pendonor.
