Abstract

The juridical procedure stipulated in Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Repayment Obligations is a formal mechanism in the legislative system. This comprehensive review intends to explore, analyze, and reveal the validity of the judicial decision of the Commercial Court Panel with Registration No. 2/Pdt.Sus-Bankruptcy/2024/PN Niaga Smg in the context of its conformity with the fundamental principles of insolvency evaluation. As well as setting an insolvency test that provides legal certainty for both parties. This research methodology applied is a type of normative research using a multidimensional approach including analysis of laws and regulations, conceptual approaches, and comparative approaches to produce comprehensive findings. The study output means that the discrepancy in the judge's consideration regarding simple proof regarding whether a debtor is solvent or not shows that there are still weaknesses in the judge's consideration that has been conveyed previously, which is supported by the absence of a binding and compelling legal instrument as a reference for judges in giving their consideration. Improvement efforts are needed, which can be started from changing the provisions of facts that can be proven simply as a form of bankruptcy process that can be completed in a limited temporal interval, but still paying close attention to the financial status of creditors through the solvency evaluation procedure that has long been applied by jurisdictions with a common law legislation system., so that in the future the number of bankruptcies can be reduced, and avoid unfounded bankruptcy processes and harm one party, especially for debtors who are still solvent.
