Abstract

Majelis Disiplin Profesi (MDP) bertanggung jawab untuk melakukan pemeriksaan terhadap kasus yang dilaporkan dan memberikan rekomendasi apakah penyidikan terhadap dokter tersebut dapat dilakukan atau tidak, ketentuan atau prosedur penyidikan tenaga medis atau dokter yang diduga melakukan perbuatan yang melanggar hukum tersebut terdapat pada Pasal 308 ayat (1) UU Kesehatan 2023 yang menyebutkan “Tenaga Medis atau Tenaga Kesehatan yang diduga melakukan perbuatan yang melanggar hukum, terlebih dahulu harus dimintakan rekomendasi dari majelis sebagaimana dimaksud dalam Pasal 304”. Tujuan dari penelitian ini adalah untuk mengetahui apa wewenang Majelis Disiplin Profesi (MDP) dalam penyelesaian sengketa medis ditinjau dari Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan dan bagaimana kekuatan putusan Majelis Disiplin Profesi (MDP) dalam penyelesaian sengketa medis. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif, dan menggunakan beberapa pendekatan diantaranya pendekatan perundang-undangan, pendekatan konseptual dan pendekatan kasus. Hasil dari penelitian ini menunjukan bahwa peran Majelis Disiplin Profesi (MDP) dalam penyelesaian sengketa medis ditinjau dari Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan adalah: 1) Melaksanakan penegakan disiplin profesi tenaga medis dan tenaga kesehatan berdasarkan ketentuan penegakan disiplin yang ditetapkan oleh menteri; 2) Penerimaan dan verivikasi pengaduan atas tindakan tenaga medis dan tenaga kesehatan; 3) Pemeriksaan pengaduan dugaan pelanggaran disiplin profesi; 4) Penentuan ada atau tidaknya pelanggaran disiplin profesi yang dilakukan tenaga medis dan tenaga kesehatan; 5) Pengambilan putusan atas pengaduan dan menentukan sanksi atas pelanggaran disiplin; dan 6) Pemberian rekomendasi yang berkaitan dengan tenaga medis dan tenaga kesehatan yang diduga melakukan tindakan/perbuatan yang melanggar hukum dalam pelaksanaan pelayanan kesehatan atau yang dimintai pertanggungjawab atas tindakan/perbuatan berkaitan dengan pelaksanaan pelayanan kesehatan yang merugikan pasien. Serta kekuatan putusan Majelis Disiplin Profesi (MDP) dalam penyelesaian sengketa medis adalah sesuai dengan pasal 306 Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan yaitu bersifat final dan mengikat bagi tenaga medis dan tenaga kesehatan. Keputusan MDP dapat berupa pemberian sanksi disiplin atau dinyatakan tidak bersalah. Sanksi disiplin yang dapat diberikan MDP, antara lain: a) Peringatan tertulis; b) Kewajiban mengikuti pendidikan atau pelatihan di penyelenggaraan pendidikan di bidang kesehatan atau rumah sakit pendidikan terdekat yang memiliki kompetensi untuk melakukan pelatihan tersebut; c) Penonaktifan STR untuk sementara waktu; dan/atau d) Rekomendasi pencabutan SIP. Kata Kunci: Kekuatan Putusan; MDP; Sengketa Medis; Hukum Kesehatan; ABSTRACT The Professional Disciplinary Panel (MDP) is responsible for conducting an examination of the reported case and providing a recommendation on whether or not an investigation against the doctor can be conducted, the provisions or procedures for investigating medical personnel or doctors suspected of committing unlawful acts are contained in Article 308 paragraph (1) of the Health Law 2023 which states “Medical personnel or health workers suspected of committing unlawful acts, must first request a recommendation from the assembly as referred to in Article 304”. The purpose of this study is to find out what is the role of the Professional Disciplinary Assembly (MDP) in resolving medical disputes in terms of Law Number 17 of 2023 concerning Health and how the strength of the decision of the Professional Disciplinary Assembly (MDP) in resolving medical disputes. The method used in this research is normative legal research, and uses several approaches including statutory approach, conceptual approach and case approach. The results of this study indicate that the role of the Professional Disciplinary Assembly (MDP) in resolving medical disputes in review of Law Number 17 of 2023 concerning Health is 1) Carrying out the enforcement of professional discipline of medical personnel and health workers based on the provisions of disciplinary enforcement stipulated by the minister; 2) Receiving and verifying complaints about the actions of medical personnel and health workers; 3) Examination of complaints of alleged violations of professional discipline; 4) Determining whether or not there is a violation of professional discipline committed by medical personnel and health workers; 5) Making decisions on complaints and determining sanctions for violations of discipline; and 6) Providing recommendations relating to medical personnel and health workers who are suspected of committing unlawful acts/actions in the implementation of health services or who are held accountable for acts/actions related to the implementation of health services that harm patients. And the strength of the decision of the Professional Disciplinary Panel (MDP) in resolving medical disputes is in accordance with Article 306 of Law Number 17 of 2023 concerning Health, which is final and binding for medical personnel and health workers. MDP decisions can be in the form of disciplinary sanctions or being found not guilty. Disciplinary sanctions that can be given by MDP include: a) Written warning; b) Obligation to attend education or training at the nearest health education organization or teaching hospital that has the competence to conduct such training; c) Temporary deactivation of STR; and/or d) Recommendation for revocation of SIP.
