Abstract

The act of gifting often leads to disputes between the recipient of the gift and the heirs of the giver, as seen in the verdict of Case No. 1050/Pdt.G/2018/PA Selong. This research aims to examine the legal strength of a gift declaration based on Civil Law and Islamic Law. From the existing background, several issues arise that need to be explored, such as: 1. What is the analysis of the verdict No. 1050/Pdt.G/2018 PA Selong? 2. What are the legal consequences of a gift from the giver to the recipient?This study employs a normative legal research method. The findings compare gift declarations from both legal systems; in civil law, according to Article 1682 of the Civil Code, a gift of immovable property must be executed through an authentic deed made before a notary.If the grant is made in the form of a grant statement or without an authentic deed, then the validity of the grant is considered invalid, but based on the Compilation of Islamic Law there is nothing that clearly regulates the use of authentic deeds regarding grants, but in Article 210 of the KHI in paragraphs 1 and 2 the grant must be witnessed by 2 people and the donated goods are their own. It is hoped that the parties involved are advised to comply with the court decision in order to maintain family harmony and prevent prolonged conflicts and any grants, especially those involving land rights, are carried out through an authentic deed made by the Land Deed Making Officer. This is to ensure legal certainty and avoid disputes in the future, and not to be null and void in the object of the grant, as well as to meet the requirements of proof before the judge
