Abstract

Marriage is a relationship in a bond that occurs and is valid between two individuals, namely a man and a woman who have agreed to form a family and live a life together as happy husband and wife. The aim of this research is to analyze people with mental disabilities as a reason for polygamy. This research uses a normative approach with a focus on studying relevant regulations related to people with mental disabilities as subjects of polygamy. The lack of clarity in regulations provides a gap for potential abuse in polygamy involving women with mental disabilities, therefore more inclusive legal protection and stricter law enforcement are needed to ensure that the rights of people with mental disabilities are respected and protected. Women with mental disabilities have the right to obtain legal protection so that they do not become victims of actions that could harm them, especially physically, emotionally and legally. The research results have shown that protection for people with disabilities is contained in Law no. 8 of 2016 concerning Persons with Disabilities, especially article 9. Thus, the law must ensure that persons with mental disabilities cannot be used as an excuse or subject in the practice of polygamy, considering their inability to give valid consent.
