Abstract

Tujuan dari penelitian ini adalah untuk mengetahui untuk mengetahui kedudukan dan kewenangan menteri triumvirat sebagai pelaksana tugas kepresidenan sebagai pengganti jabatan Presiden dan Wakil Presiden yang berhalangan tetap dengan sistem pemerintahan presidensial dalam UUD NRI 1945 dan untuk menjelaskan pertanggungjawaban hukum Menteri Triumvirat sebagai pelaksana tugas kepresidenan dalam hal Presiden dan Wakil Presiden yang berhalangan tetap. Penelitian ini adalah penelitian hukum dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Hasil dari penelitian ini adalah bahwa diketahui kedudukan menteri adalah sebagai pembantu Presiden, hal ini termuat dalam Pasal 17 UUD NRI 1945, artinya menteri berperan sebagai pejabat yang membantu Presiden dalam melaksanakan tugas-tugas pemerintahan. Menteri diangkat dan diberhentikan hanya oleh Presiden. Persyaratan pengangkatan dan pemberhentian menteri oleh Presiden senantiasa agar tercipta penyelenggaraan tugas pemerintahan, sehingga pertanggungjawaban menteri adalah kepada Presiden. Dalam Pasal 8 ayat (3) UUD NRI 1945 disebutkan bahwa pelaksana tugas kepresidenan adalah menteri luar negeri, menteri dalam negeri, dan menteri pertahanan atau dalam satu kesatuan disebut “menteri triumvirat”. Kedudukannya yaitu sebagai pelaksana tugas kepresidenan disaat Presiden dan Wakil Presiden berhalangan tetap. Menteri triumvirat pada dasarnya adalah menteri pada umumnya, hanya saja kedudukannya lebih kuat daripada menteri lainnya karena menteri triumvirat disebutkan dalam UUD NRI 1945. Sebagai pelaksana tugas kepresidenan yang menjalankan hak, kewenangan dan kewajiban Presiden, maka pertanggungjawaban menteri triumvirat terdiri dari pertanggungjawaban politik, pertanggungjawaban moral, dan pertanggungjawaban hukum.
