Abstract

Indonesia sebagai negara hukum berarti bahwa seluruh aspek kehidupan berbangsa dan bernegara diatur oleh hukum, yang secara jelas dinyatakan dalam Undang- Undang Dasar Pasal 1 ayat (3) Negara Republik Indonesia (UUD NRI) tahun 1945 yang berbunyi "Negara Indonesia adalah Negara Hukum". Hukum dasar itulah yang menjadi pegangan sekaligus dasar pengambilan keputusan-keputusan penting dalam kehidupan masyarakat suatu negara. Hukum atau aturan sebagai kaidah hidup dalam pergaulan masyarakat mencerminkan cita-cita dan sistem nilai yang berlaku umum dalam masyarakat. Sebuah negara dengan Konsep negara hukum ini menegaskan bahwa tidak ada satu pun tindakan yang dapat dilakukan tanpa dasar hukum yang jelas, permasalahan kekerasan dan intimidasi dalam konteks digital semakin meningkat, menimbulkan kebutuhan mendesak untuk memahami implikasi hukum dari tindakan tersebut dalam kerangka regulasi yang ada. Asas lex certa, yang mengedepankan kepastian dan kejelasan hukum, menjadi landasan penting dalam penegakan hukum di bidang informasi dan transaksi elektronik. Penelitian ini bertujuan untuk menganalisis bagaimana tindakan kekerasan dan/atau menakut- nakuti dapat melanggar asas ini, serta konsekuensi hukum yang dapat ditimbulkan bagi pelaku dan korban. Dalam konteks ini, kekerasan dan menakut-nakuti dapat berupa ancaman fisik, intimidasi psikologis, atau pemaksaan yang dilakukan melalui media digital, yang berpotensi merugikan individu dan masyarakat secara luas dalam UU ITE yang relevan dengan tindakan kekerasan dan menakut-nakuti, serta menganalisis bagaimana ketentuan tersebut dapat diterapkan dalam praktik. Hasil penelitian menunjukkan bahwa meskipun UU ITE mengatur sanksi bagi pelaku tindakan yang merugikan, seperti pencemaran nama baik dan ancaman, implementasi hukum seringkali terhambat oleh kurangnya kepastian dalam definisi dan klasifikasi tindakan kekerasan di dunia maya.
