Abstract

The principle of equality before the law, which is the basis of the rule of law as stated in Article 27 paragraph (1) of the 1945 Constitution of the Republic of Indonesia, emphasizes that all citizens are equal before the law and government with no exceptions. However, the rules for the resignation of public officials who will run for re-election to public office vary among the various existing laws and regulations. These differences in rules have the potential to lead to unequal treatment of public officials, which violates the principle of equality before the law mandated by the 1945 Constitution of the Republic of Indonesia as the Indonesian state constitution. This study aims to determine and analyze the suitability of resignation arrangements for public officials who will run for re-election to public office according to the perspective of equality before the law in the 1945 Constitution of the Republic of Indonesia. This research is a normative research approach to legislation, concept approach, and case approach to analyze various legal concepts and provide relevant legal prescriptions. Based on the results of the research, the application of the law regarding the resignation of public officials who run for office is still not in accordance with the principle of equality before the law. Meanwhile, the regulation of the resignation of public officials in accordance with the principle of equality before the law, if the legislation is not required for public officials to resign, then the regulation should also not require other public officials to resign. Conversely, if the legislation requires resignation for public officials who are running for other public positions, then the obligation must also apply equally to all public officials without exception.
