Abstract

Sistem peradilan yang ada di Indonesia adalah lembaga atau institusi yang menegakkan hukum untuk menyelesaikan perselisihan dan mencari keadilan. Peradilan di Indonesia didasarkan pada prinsip-prinsip yang dijamin oleh undang-undang, dan hakim diharapkan bertindak independen dan tidak memihak serta mematuhi prinsip-prinsip keadilan. Dalam suatu perkara Perkawinan yang ujungnya terjadi Perceraian menyebabkan akibat hukum seperti Hak Asuh Anak dan Pembagian Harta Perkawinan. Hak Asuh Anak sering Menjadi Permasalahan yang nantinya Hakim harus adil dan benar-benar memahami perkara tentang pembatalan Hak Asuh Anak. Penelitian ini bertujuan untuk mengetahui dasar hukum pertimbangan hakim dalam memutus perkara nomor No. 744/Pdt. G /2023/PA.Mlg di Pengadilan Agama Malang, yang telah dibatalkan oleh Mahkamah Agung melalui putusan No. 291 K / Ag/ 2024. Adapun bahan hukum yang digunakan pada penelitian karena bahan hukum merupakan elemen penting dalam penelitian hukum, terutama karena menjadi dasar analisis dan argumentasi, bahan hukum meliputi bahan hukum primer yaitu sumber hukum yang memiliki kekuatan hukum mengikat, bahan hukum sekunder yaitu bahan yang memberikan penjelasan atau analisis terhadap bahan hukum primer atau peninjauan salinan putusan perkara nomor 744/Pdt. G/2023/PA.Mlg jo. Nomor. 426/Pdt.G/2023/PTA.Sby jo. No. 291 K/Ag/2024 dan tersier. hasil dari penelitian ini bahwa orang tua masih bertanggung jawab atas hak asuh anak jika masih di bawah umur, sebab anak di bawah umur memiliki kondisi psikologis yang masih labil dan hak asuh juga mempengaruhi kondisi anak tersebut. Dalam memutus perkara, hakim dalam praktiknya harus mengikuti prinsip keadilan, kepastian hukum, dan kenyamanan dalam mengambil keputusan. Dengan demikian, perlu dipastikan tidak terjadi kesalahpahaman di antara para pihak dalam memutus perkara, dan tidak terjadi kesalahpahaman terhadap keputusan kedua belah pihak. Baik tergugat maupun penggugat dapat menerima apapun keputusan hakim.
