Abstract

Hukum berperan penting sebagai pedoman dalam menciptakan keadilan dan ketertiban, termasuk dalam mengatur jangka waktu pemberian Hak Guna Bangunan (HGB) di Indonesia. Ketentuan mengenai HGB telah diatur dalam Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (UUPA), yang membatasi masa berlakunya hingga maksimal 50 tahun. Namun, Peraturan Pemerintah Nomor 12 Tahun 2023 menetapkan perpanjangan jangka waktu HGB hingga mencapai 160 tahun, sehingga menimbulkan konflik norma antara kedua peraturan tersebut. Konflik ini mengindikasikan adanya permasalahan dalam penerapan prinsip hierarki peraturan perundang-undangan, yang mengatur bahwa undang-undang memiliki kedudukan lebih tinggi dibandingkan dengan peraturan pemerintah. Penelitian ini menggunakan metode normatif dengan pendekatan peraturan perundang-undangan serta pendekatan konseptual untuk menganalisis aspek normatif terkait ketentuan hukum dan memberikan solusi preskriptif yang sesuai. Fokus penelitian diarahkan pada kesesuaian antara PP No. 12 Tahun 2023 dengan UUPA dalam konteks pengaturan jangka waktu HGB. Hasil penelitian menunjukkan bahwa terdapat ketidaksesuaian antara kedua regulasi tersebut, yang berimplikasi pada konflik hukum berdasarkan asas lex superior derogat legi inferiori, yakni bahwa peraturan yang memiliki hierarki lebih tinggi harus diutamakan. Oleh karena itu, ketentuan dalam PP No. 12 Tahun 2023 yang memperpanjang jangka waktu HGB perlu disesuaikan agar tidak bertentangan dengan UUPA. Penyesuaian ini sangat penting untuk memastikan adanya harmonisasi, keadilan, dan kepastian hukum dalam pengaturan hak atas tanah. Dengan demikian, pembenahan regulasi diharapkan dapat mendukung terciptanya keselarasan hukum yang lebih baik, sesuai dengan prinsip-prinsip dasar agraria yang diatur dalam UUPA.
