Abstract

The fourth revision of Law Number 7 of 2020 concerning the Third Amendment to Law Number 24 of 2003 has sparked controversy. It introduces the concept of recalling constitutional court judges through the approval of the proposing institution. The lack of public involvement in the process of drafting this amendment clearly reflects a normative conflict (antynomy normen) with the regulations governing the formation of legislation. So from this research, two problem formulations were obtained, namely whether the current regulation of the term of office of constitutional court judges reflects the principles of a state of law and whether the provisions in Article 23A and Article 87 in the fourth revision of Law Number 7 of 2020 concerning the Third Amendment to Law Number 24 of 2003 concerning the term of office of constitutional court judges support the strengthening of autocratic legalism. Through normative legal analysis with the methods of legislative and conceptual approaches, this study examines the regulation of the term of office against the principles of a state of law, particularly regarding judicial independence and accountability, while identifying potential risks of autocratic legalism. The results show that the regulation has not fully adhered to the rule of law principle in Article 1, paragraph (3), of the 1945 Constitution. Flexibility in filling positions risks political intervention, threatening judicial independence. In Addition, Article 23A and Article 87 in the revision have the potential to weaken the constitutional court's role as a guardian of the constitution, fostering autocratic legalism in legislative processes.
