Abstract

Adanya penelitian ini bertujuan untuk mengetahui perlindungan wartawan terhadap UU Pers dan UU ITE, menganalisa secara faktual konkret terhadap perlindungan hukum terhadap wartawan tentang pencemaran nama baik melalui UU Pers terhadap UU ITE Pasal 27 Ayat (1). Melalui penelitian ini akan dibahas tuntas mengenai kebebasan wartawan dalam hal penyampaian berita yang bersangkutan dengan nama baik seseorang maupun instansi agar mendapatkan perlindungan hukum yang tetap dan tepat karena adanya pasal multitafsir dalam UU ITE. Dalam penelitian ini akan dilakukan dengan metode penelitian hukum normatif yang diiringi dengan pendekatan terhadap peraturan dan pendekatan secara konseptual yang tentunya didasarkan pada bahan hukum primer, sekunder, dan tersier yang masih memiliki relevansi dengan topik pembahasan dengan teknik legal reasoning. Dalam faktanya kegiatan jurnalistik dengan kebebasan pers memang memiliki kekuatan untuk memberikan dampak terhadap apa yang telah diinfomasikannya yang dapat mempengaruhi sikap maupun perilaku seseorang maupun golongan dalam artian masyarakat sehingga memiliki pandangan sesuai dengan informasi yang didapat tersebut. Namun dalam hal ini perlu dinilai dan dipandang lebih jauh atas kebebasan pers dalam membawakan sebuah berita untuk kepentingan publik dan pencerdasan kehidupan bangsa agar tidak mendapatkan ketimpangan tindihan sebuah aturan dan kepentingan pribadi yang tidak bertolak ukur atau tidak sesuai dengan aturan yang ada, agar juga para penegak hukum tidak salah dalam pengambilan keputusan atas sebuah laporan yang mengkriminalisasi kan seorang wartawan dan agar pandangan publik bisa terbuka selebar-lebarnya atas cara kerja seseorang yang telah menjadi tokoh dalam bangsa ini,maupun kegiatan politik yang ada didalam pemerintahan, agar dapat kembali nya kebebasan pers yang menjadi salah satu pilar demokrasi dalam sebuah pemerintahan
