Abstract

Perkawinan bukan sekadar mempersatukan antara seorang pria dan seorang wanita pada suatu hubungan yakni keluarga, karena dengan seiring berjalannya waktu terdapat kehadiran keturunan dan harta kekayaan yang memiliki keterkaitan satu sama lainnya yaitu waris. Hak waris yang dimiliki ahli waris perlu mendapat kepastian secara hukum demi keberlangsungan kepemilikan dari harta kekayaan tersebut dan pembagiannya, karena yang berhak atas harta peninggalan pewaris adalah keturunan dan pasangan yang hidup terlama. Pada putusan pengadilan Nomor 204/Pdt.G/2023/PN.Sby Hakim memutuskan bahwa istri dari suami yang mewaris bukanlah ahli waris karena adanya perjanjian kawin pisah harta yang dilaksanakan pada saat perkawinan berlangsung. Jenis penelitian yang digunakan adalah hukum normatif yang dilakukan dengan menggunakan studi kepustakaan dan menggunakan metode pendekatan undang-undang KUH Perdata dan UU Perkawinan, pendekatan konseptual, dan pendekatan kasus. Hasil penelitian dari permasalahan yang diangkat tersebut dapat disimpulkan bahwa kedudukan istri atau pasangan yang hidup paling lama sama haknya dengan anak-anak dalam hal menerima hak waris yang sama besarnya. Meskipun dalam perkawinan tersebut terdapat sebuah perjanjian kawin yang mengatur terkait pemisahan harta antar pasangan, hal tersebut tidak memengaruhi atau menghalangi antara suami dan istri untuk saling mewarisi. Halhal yang dapat menghalangi seseorang untuk mendapat hak warisnya ialah orang yang mengambil nyawa pewaris atau yang melakukan tindak pidana lainnya.
