Abstract

Tindakan roasting, yang merupakan bagian dari seni stand-up comedy, kerap menuai perdebatan terkait batasan hukum dan etika, terutama ketika subjek yang diroasting merasa dirugikan secara pribadi atau reputasinya tercemar. Penelitian ini bertujuan untuk menganalisis apakah tindakan roasting dapat dikategorikan sebagai pencemaran nama baik berdasarkan hukum positif di Indonesia. Dengan menggunakan pendekatan konseptual, penelitian ini mengkaji pengaturan hukum dalam KUHP dan Undang-Undang No 11 Tahun 2008 yang mengatur tentang pencemaran nama baik. Hasil penelitian menunjukkan bahwa tindakan roasting dapat dianggap sebagai pencemaran nama baik apabila memenuhi unsur subjektif dan objektif yang diatur dalam Pasal 310 dan 311 KUHP serta Pasal 27 Ayat (3) Undang-Undang No 11 Tahun 2008. Namun, konteks seni dan humor dapat menjadi faktor pertimbangan dalam proses hukum. Studi ini menegaskan pentingnya keseimbangan antara kebebasan berekspresi dan penghormatan terhadap hak asasi manusia, khususnya hak atas kehormatan dan nama baik. Diharapkan hasil penelitian ini dapat memberikan wawasan bagi pelaku seni dan masyarakat dalam memahami implikasi hukum dari tindakan roasting. Implikasi hukum dari roasting terhadap kebebasan berpendapat sangat rumit. Meskipun kebebasan berpendapat dilindungi oleh undang-undang, undang�undang pencemaran nama baik yang ketat dapat membatasi kebebasan berpendapat, terutama jika materi roasting dianggap melanggar hak-hak individu yang dilindungi oleh undang-undang. Komedian dapat mengalami self-censorship, menghentikan kreativitas mereka, dan menahan kritik yang wajar terhadap tokoh publik atau fenomena sosial. Oleh karena itu, untuk memastikan bahwa tidak ada pihak yang dirugikan dari segi kreativitas atau hak-hak pribadi, penting untuk menyeimbangkan perlindungan terhadap kebebasan berekspresi dengan perlindungan martabat individu.
