Abstract

Human life is inseparable from land as a place or foundation for building a house as a residence; the role of land is very important, especially as a social status and indicator of a person's success. This sufficiently proves that land cannot be separated from human interests, as people want to own land, among other reasons, to ensure the livelihood of their descendants. The basic agrarian law accommodates the transfer of land rights through inheritance, grants, and sales. The government, through the National Land Agency as the organizer of land rights determination and land registration, must be involved in the process of transferring land rights. The transfer of land rights through grants must be based on Article 37 of Government Regulation No. 24 of 1997 concerning land registration, which states that the transfer of land rights must be evidenced by a deed made by the authorized PPAT in accordance with applicable law. Although it is a unilateral agreement, a gift is not free from legal issues such as the lack of free will of the donor to give their land to another party, which can violate the rights of legitimate heirs through coercion in the form of pressure, intimidation, or threats from another party.
