Abstract

Asas keseimbangan merupakan prinsip penting dalam hukum kontrak yang bertujuan menjamin keadilan dan kesetaraan hak dan kewajiban bagi para pihak dalam suatu perjanjian, terutama dalam perjanjian kredit benda produktif seperti Grab Mobil. Melalui ini, mitra pengemudi memperoleh kendaraan yang dibiayai oleh lembaga keuangan untuk tujuan produktif, namun sering kali dihadapkan pada syarat dan ketentuan yang menguntungkan kreditur. Ketidakseimbangan tersebut berpotensi menimbulkan ketidakadilan bagi mitra pengemudi yang memiliki posisi tawar lemah. Berdasarkan pasal-pasal dalam Kitab Undang-Undang Hukum Perdata (KUHPerdata), asas keseimbangan mengarahkan pada kontrak yang tidak hanya sah, namun juga memperhatikan prinsip kepatutan dan keadilan. Dalam pembahasan ini, terdapat dua rumusan masalah yakni, Asas keseimbangan dalam perjanjian kredit benda produktif (Grab Mobil) dan Akibat hukum terhadap tidak adanya asas keseimbangan bagi para pihak dalam perjanjian kredit benda produktif (Grab Mobil). Dilakukan analisis terhadap penerapan asas keseimbangan melalui tiga pendekatan, pendekatan peraturan perundang-undangan untuk mengidentifikasi landasan hukum, pendekatan konsep untuk memahami teori-teori hukum terkait, dan pendekatan perbandingan untuk mempelajari implementasi asas ini dalam sistem hukum lain. Dengan pendekatan ini, analisis diharapkan memberikan gambaran komprehensif mengenai penerapan asas keseimbangan dalam perjanjian kredit benda produktif, guna menciptakan perjanjian yang adil dan layak bagi semua pihak. Asas pacta sunt servanda dan kebebasan berkontrak juga memberikan dasar hukum yang kuat untuk penerapan asas keseimbangan. Melalui perbandingan dengan negara lain, terlihat bahwa Indonesia dapat meningkatkan perlindungan debitur dengan regulasi khusus yang memastikan hak konsumen terlindungi dalam perjanjian kredit. Penerapan asas keseimbangan dan proporsionalitas dalam perjanjian kredit Grab Mobil memastikan hubungan kontraktual yang adil. Hal ini melindungi hak debitur, mencegah eksploitasi, dan menjadikan kredit sebagai instrumen pemberdayaan ekonomi, sekaligus mendorong hubungan saling menguntungkan antara lembaga pembiayaan dan pengemudi.
