Abstract
Rekomendasi tertulis camat dalam tata cara pemberhentian perangkat desa memuat ketentuan pengaturan yang tidak jelas mengenai rekomendasi tertulis tersebut. Penelitian ini bertujuan untuk mengkaji implikasi Peraturan Pemerintah Nomor 43 Tahun 2014 Terkait rekomendasi tertulis dalam proses pemberhentian perangkat desa. Berdasarkan latar belakang yang ada, timbullah permasalahan yang harus ditelaah, seperti 1. Bagaimana legal binding rekomendasi tertulis dalam proses pemberhentian perangkat desa?, 2. apa implikasi Peraturan Pemerintah Nomor 43 Tahun 2014 terkait rekomendasi tertulis dalam proses pemberhentian perangkat desa. Metode penelitian ini menggunakan metode hukum normative dengan menggunakan pendekatan perundang-undangan (statute aprroach) dan pendekatan konseptual (konseptual approach) digunakan untuk mengkaji dan menganalisis kerangka pikir dalam menemukan isu hukum yang di hadapi. hasil penelitian ini menunjukkan bahwa camat sebagai perangkat daerah mempunyai tugas membina dan mengawasi kegiatan desa, sebagaimana diatur dalam Pasal 225 Ayat 1 huruf g UU Nomor 23 Tahun 2014. Camat memiliki tugas melakukan pengawasan terhadap perkembangan dan pelaksanaan kegiatan desa dan/atau kelurahan. Rekomendasi camat memiliki sifat Legal binding karena sudah diatur dalam Peraturan Pemerintah Nomor 43 Tahun 2014. Dan Implikasi Peraturan Pemerintah Nomor 43 Tahun 2014 itu rekomendasi camat mengakibatkan Peraturan Bupati Sumenep Nomor 8 Tahun 2020 bisa melakukan pemberhentian perangkat desa tanpa rekomendasi camat.
