Abstract
Dengan pesatnya perkembangan masyarakat, berbagai tindak pidana telah menjadi fenomena sosial dan memerlukan perhatian khusus. Permasalahan pencemaran lingkungan, terutama yang berasal dari bahan kimia dan partikel, telah menjadi isu global yang semakin mendesak. Salah satu jenis polutan yang saat ini banyak menarik perhatian adalah mikroplastik. Mikroplastik merupakan partikel plastik berukuran sangat kecil yang menyerang berbagai ekosistem mulai dari lautan hingga daratan, dan bahkan ditemukan juga didalam tubuh manusia. Rumusan Masalah dalam penelitian ini bagaimana karakteristik limbah mikroplastik sebagai bahan pencemar; bagaimana pertanggungjawaban pidana pelaku penghasil limbah pencemaran mikroplastik. Tujuan dalam penelitian ini mengetahui karakteristik limbah mikroplastik juga termasuk dalam limbah mikroplastik sebagai bahan pencemar, serta untuk mengetahui pertanggung jawaban pidana terhadap penghasil pencemaran mikroplastik. Manfaat dalam penelitian ini memberikan wawasan dan pengetahuan mengenai bagaimana karakteristik limbah mikroplastik sebagai bahan pencemar dan diharapkan dapat memberikan masukan kepada pembentuk kebijakan mengenai pertanggungjawaban pidana pelaku penghasil limbah mikroplastik. Metode yang digunakan penelitian yuridis normatif dengan menggunakan metode penelitian pendekatan perundang-undangan dan pendekatan konseptual. Menggunakan bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier, dengan teknik pengumpulan bahan hukum studi kepustakaan dan menggunakan teknik analisis normatif yang bersifat preskriptif. Kesimpulan dalam penelitian ini limbah mikroplastik merupakan pencemaran yang semakin mengkhawatirkan, termasuk di Indonesia. Penghasil pencemaran mikroplastik dapat dikenakan sanksi pidana berdasarkan Undang-Undang No. 32 Tahun 2023 tentang Perlindungan dan Pengelolaan Lingkungan Hidup. Tanggungjawab pidana mencakup individu dan korporasi, namun penegakan hukum menghadapi tantangan dalam membuktikan hubungan antara tindakan pelaku dan dampak pencemaran.
