Abstract
Indonesia is a country based on the 1945 Constitution based on Pancasila as the main source of law. Indonesia regulates the movement of people in and out through Law Number 6 of 2011 concerning Immigration. However, challenges arise when refugees or asylum seekers including the Rohingya ethnic group enter Indonesian territory without meeting the specified requirements such as having a valid visa. Rohingya refugees fleeing oppression in Myanmar face a complex situation because Indonesia has not ratified the Convention Relating to the Status of Refugees 1951. On the one hand, international principles such as non-refoulement, non-penalization, and non�discrimination require states to protect refugees from expulsion anddiscriminatory treatment. On the other hand, Indonesia's domestic regulations have not fully accommodated comprehensive protection for them. The basic rights of refugees are regulated by international law including the rightsto security, employment, education, housing, and legalservices as stipulated in the 1951 Convention. This study uses a normative legal method with two approaches, namely the statutory and conceptual approaches. The statutory approach examines related regulations to understand their rationality and philosophical basis, while the conceptual approach examines the doctrines and views of legal experts to build relevant arguments. The technique of collecting legal materials is carried out through a review of positive legal norms such as laws and regulations and academic doctrines from books, journals,and other scientific works. Based on this study, it is important for Indonesia to align national policies with international standards to ensure respect for the human rights of Rohingya refugees. Increasing international cooperation in adjusting domestic regulations, and recognizing the legal status of refugees are key steps to strengthen Indonesia's role in facing global challenges related to refugees.
